Introduction

Welcome. This website is operated by Rainbow Kitchen, LLC, which may be referred to as “Rainbow Kitchen”, “we”, “us” and “our” throughout this agreement and our website.

 

By visiting our website or purchasing from us, you agree to be bound by these Terms and Conditions, which apply to all site visitors, including browsers, customers, vendors and other business partners.

  1. Acceptance of Terms and Conditions. By using our sign, subscribing to email and/or purchasing from us, you agree to be bound by these Terms and Conditions.

  2. Modifications of Terms and Conditions. We reserve the right to modify these Terms and Conditions from time to time at our sole discretion.

  3. Product and pricing updates. We are working hard to offer helpful products and services of the highest quality at a reasonable price. We reserve the right to make changes to the products and services offered on our website, and any components thereof, including price, at any time.

  4. Availability. All orders are subject to acceptance and availability. We reserve the right to cancel any orders that we are unable to fill for any reason. You will receive an email notification that your order has been canceled.

  5. Food safety, allergies and dietary preferences. It is your responsibility to review the ingredients and notify us of any allergies or dietary restrictions. By purchasing food products and services from us, you acknowledge and accept the following:

    • Our food is prepared according to the safety guidelines outlined by the CDC and the American Academy of Pediatrics.

    • Our food is free of tree nuts and peanuts, however we cook in a shared facility so our food may come into contact with these allergens.

    • Our food may include allergens including milk, eggs, fish, shellfish, wheat, soybeans and sesame. As we grow, we hope to provide more options that cater to children with allergies other than nuts.

  6. ​User information accuracy. By purchasing food products and services from us, you agree to provide accurate and complete information about you and your child’s needs. You agree to disclose any tree nut and peanut allergies to us when placing your order, and acknowledge that we prepare food in a shared facility. By purchasing from us, you confirm that your child does not have any other food allergies.

  7. Refunds. Because we are working to provide an innovative, high quality product at a reasonable price, our business operates on extremely thin margins. Therefore, all sales are final. However, we are here to serve you and will always do our best to accommodate any issues or concerns you may have. If this is the case, send us a note at hello@rainbowkitchenkids.com or submit the contact form on our site.

  8. Cancellations. You can cancel or pause a monthly subscription up to 5 days before the start of the next month (at which point we begin to incur related expenses). This must be done manually, be sending us a note at hello@rainbowkitchenkids.com.

  9. Food storage and maintenance. We will provide equipment and instructions as needed to all partner schools to maintain the integrity of our food until consumption per the agreed-upon schedule. We are not responsible for maintaining the integrity of food products after they have been delivered.

  10. Intellectual property. All content on our website and marketing materials is the property of Rainbow Kitchen, and may not be reproduced or distributed without our prior written permission.

  11. Disclaimer of warranties and limitation of liability. To the fullest extent permitted by law, Rainbow Kitchen shall not be liable for any indirect, incidental, special, consequential or punitive damages resulting from your use of our services or consumption of our content.

    • Results. Rainbow Kitchen cannot guarantee any outcomes as a result of purchasing our services or consuming our content.

    • Content. Recipes, recommendations and other content provided on our website, social media, email or other marketing materials is created referencing qualified sources such as medical journals. This content is intended to help you make informed decisions about your child’s nutrition and is not a substitute for the advice of your child’s physician. No actions should be taken based solely on our content.

    • Allergies. Rainbow Kitchen cannot guarantee that your child will be free from allergic reactions to food that we provide. Rainbow Kitchen expressly disclaims any and all damages related to such an event.

  12. Indemnification. You agree to indemnify, defend, and hold harmless Rainbow Kitchen, its officers, directors, employees, agents, and affiliates, from and against any claims, liabilities, damages, losses, and expenses, including without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your use of our services.

  13. Governing Law. These Terms are governed by and construed in accordance with the laws of New York, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of New York.
